2. Data processed, purpose and legal basis of the processing

a) Data generated by access to the site

3. Nature of the conferment

Apart from that specified for navigation data and data collected through the MailchimpPlatform, the provision of data: with respect to the purposes referred to in letters a), b), c) is optional, but refusal will make it impossible for Campante & Abreu to carry out its contractual obligations. These General Terms and Conditions of Sale apply to all sales made by Campante & Abreu on the website. The General Terms and Conditions of Sale may be modified at any time by Campante & Abreu. Any changes and/or new conditions will be in force from the moment they are published in the “Conditions of Sale” section of the website. For this reason, users are invited to regularly access the website and check the publication of the most updated General Terms and Conditions of Sale. The applicable General Terms and Conditions of Sale are those in force on the date on which the purchase order is placed.

The purchase proposals on the website are addressed to natural persons and in any case to non-commercial subjects. Therefore, purchase contracts stipulated by resellers or wholesalers or by any entities who purchase the products for subsequent resale will be cancelled. Campante & Abreu therefore reserves the right not to accept orders from entities who are not consumers or who place orders in abnormal quantities compared to the quantity of products on the website or with excessive frequency.

Purchase requests are accepted from all over the world and we remind you that customers requesting shipment of their order outside the European Community are required to pay customs duties upon receipt of the order and that these duties are not quantifiable by Campante & Abreu. The cost of the transport of the order does not include any customs or related expenses. In no case or situation is Campante & Abreu liable for the payment of any obligations arising from customs.

In order to make purchases on the website it is not necessary to register on the website, nevertheless it is necessary to accept, by ticking the appropriate box, these General Terms and Conditions of Sale every time you place an order. Failure to accept the General Terms and Conditions of Sale will make it impossible to make purchases on the website.

In order to register on the website, the user must fill in the appropriate form, entering his first name, last name, an e-mail address, a password and his residential address.

The registration credentials must be used exclusively by the user and cannot be transferred to third parties. The user undertakes to keep them secret and to ensure that no one has access to them. He must inform Campante & Abreu without any delay in case of suspicion of improper use and/or disclosure of the same.

The user guarantees that the personal information provided during the registration procedure on the website is complete and true. Should the data provided be incorrect or incomplete, the user will hold Campante & Abreu harmless from any obligation to pay compensation and/or consequent sanctions.

All prices of the products offered for sale on the website are expressed in Euros (€) and are inclusive of Value Added Tax (“VAT”) if due. Shipping costs are included in the price and will not be charged to the user separately; any other additional cost, including VAT, will be expressly and separately indicated on the order form before the user proceeds to send it as well as on the order confirmation e-mail.

The price of the products may be modified without prior notice, it being understood that the price charged to the user will be the price published on the product sheet at the time the order is placed. The products will remain the property of Campante & Abreu until the user has paid the purchase price and any other additional costs.

The purchase order will be processed only after Campante & Abreu receives confirmation of payment of the total amount due, consisting of the purchase price, and any other additional cost, as indicated in the order form. Campante & Abreu reserves the right to refuse orders from users who do not give sufficient guarantees of solvency or with whom disputes are pending and/or who present abnormal purchasing behaviour.

Due to the possibility of several users purchasing the same product at the same time, it may happen that the product ordered is no longer available after the purchase order has been placed. If the product ordered is no longer available, the customer will be promptly informed by e-mail and the purchase order will be cancelled. Campante & Abreu will refund the total amount paid by the user – consisting of the purchase price and any other additional cost – immediately, and in any case within thirty days from the day after the order was placed.

The amount of the refund shall be communicated by e-mail and credited to the same means of payment used by the user for the purchase.

Any delays in crediting may depend on the bank or the type of credit card used for payment. In any case, the value date of the amount credited will be the same as that of the debit.

In the event of failure to indicate a specific delivery period, delivery will take place, in any case, within thirty days from the day after the order is placed.

The products ordered will be sent to the postal address specified by the user on the order form.

Upon delivery of the products to the carrier, the user will be sent an e-mail confirming the shipment.

Delivery is completed when the product is made available to the user at the delivery address specified on the order form. In the event of non-delivery due to the absence of the recipient at the specified address, the courier shall make up to 3 attempts during business hours, then leave a card to certify the delivery attempt. The postcard will contain contact details for the courier and an appointment for delivery within the next 5 days. After 5 days, Customer Service will send an e-mail to the user to agree a new delivery date. If this attempt is also unsuccessful, the purchased product will be sent back to Campante & Abreu, with the warning that, after 30 days from the date the product was sent back to Campante & Abreu, the contract will be considered terminated and the purchase order cancelled.

Once the contract has been resolved, Campante & Abreu will proceed to refund the total amount paid by the user, after deducting the costs of the unsuccessful delivery of the product as well as the costs of returning it to Campante & Abreu and the storage costs. The termination of the contract and the amount of the refund will be communicated to the user by e-mail.

The amount of the refund will be credited to the means of payment used by the user for the purchase.

If, before the 30 days have elapsed, the user asks to receive the purchased product again, Campante & Abreu will proceed with the new delivery, charging, in addition to the costs of the same, the costs of returning the product to Campante & Abreu and the costs of storage.

If the purchased product is not delivered or is delivered late, the user may complain to Customer Service by e-mail at customer_care@campante.pt.
Campante & Abreu will examine the complaint and, if the non-delivery or delay in delivery is attributable to Campante & Abreu and is not due to unforeseeable circumstances or force majeure or in any case circumstances beyond the control of Campante & Abreu, without prejudice to the user’s right to use the ordinary means of protection available to him/her under the law, Campante & Abreu will refund the total amount paid by the user – consisting of the purchase price and any other additional cost – immediately, and in any case within thirty days from the day the user is notified of the outcome of the complaint.

In all of the above cases, the amount of the refund will be communicated to the user by e-mail and credited to the same means of payment used by the user for the purchase. Any delays in crediting may depend on the bank or the type of credit card used for payment. In any case, the value date of the amount credited shall be the same as that of the debit;

It is up to the user to check the condition of the product delivered. In the event that the package shows obvious signs of tampering or alteration, the user must promptly notify Customer Service by e-mail at the address indicated in the introduction.

Users who have purchased products through the Site have the right to withdraw from the contract concluded with Campante & Abreu without any penalty and without specifying the reason, within 14 (fourteen) working days from the date of receipt of the goods.

The customer service will send you the appropriate electronic label for the return of the goods.

The user shall provide, within 14 working days from the date of receipt of the goods, for the shipment of the purchased product(s), properly protected and packed in their original packaging, accompanied by any accessories. The essential condition for the exercise of the right of withdrawal is the substantial integrity of the product to be returned. The products, therefore, must not have been damaged or altered and may be returned only with the identification tag and/or labels and/or disposable seal, if any, are still attached to the products intact and not tampered with.

Only after receiving the product/s and only after positively verifying compliance with the terms and conditions for the exercise of the right of withdrawal as well as the integrity of the products, as specified in point 4 above, Campante & Abreu will proceed, in the shortest time possible, and, in any case, within thirty days from the date on which Campante & Abreu became aware of the exercise of the right of withdrawal, to refund the amount paid by the user.

Campante & Abreu will proceed to refund the total amount paid by the user, after deducting the costs of the delivery of the product as well as the costs of returning it to Campante & Abreu.

The amount of the refund will be communicated by e-mail and credited to the same means of payment used for the purchase. The value date of the refunded amount shall be the same as that of the debit.

The right of withdrawal is excluded in the event that the sale concerns products made through special order, tailor made, by measure or personalized or which by their nature cannot be returned or are liable to deteriorate or expire rapidly.
